Anita Clifford quoted on cannabis investment and AML

Anita Clifford

Anita Clifford recently provided comments for an article published in Law 360 entitled ‘UK AML laws cast a haze over legal cannabis investment’. Anita explained the nuanced position of the legality of cannabis investment, saying, “whether it is considered legal and where the activity is conducted will determine whether it will constitute criminal property under POCA.” The issue is complicated further by the need to look at ‘the type of cannabis activity undertaken.’

Anita assessed the ‘highly doubtful’ intention for POCA to catch cannabis investment in Canada, for example, but highlighted the broad definition of ‘criminal conduct’ in the UK AML framework making legality uncertain.
